Superbonus, il limite delle due unità immobiliari
Gli interroganti hanno chiesto se, in caso di demolizione e ricostruzione di un immobile, il proprietario al 50%, che ha già utilizzato l’agevolazione del Superbonus per la riqualificazione energetica di altri due immobili, possa aver comunque diritto all’agevolazione per la riqualificazione energetica di un ulteriore immobile ovvero se l’altro proprietario al 50% possa cumulare l’agevolazione, al fine di non perdere la possibilità di fruire del beneficio.
Il Ministero ha spiegato che le persone fisiche possono usare il Superbonus per la riqualificazione energetica su un numero massimo di due unità immobiliari. Tale limitazione non opera, invece, per gli interventi finalizzati al risparmio energetico realizzati sulle parti comuni e per i lavori antisismici.
Il limite, ha spiegato il Ministero, non è correlato agli immobili oggetto degli interventi, ma ai contribuenti interessati dall’agevolazione. Questo significa che il soggetto che ha già usufruito del Superbonus sulla riqualificazione energetica dei due immobili non può ottenere il Superbonus anche per la riqualificazione energetica dell’immobile di cui è comproprietario. Diversamente, l’altro comproprietario può ottenere il Superbonus a condizione che non ne abbia già usufruito nei limiti previsti.
Superbonus e montascale
Gli interroganti hanno chiesto anche se l’installazione di un montascale è agevolabile con il Superbonus.
Il Ministero ha risposto che l’intervento è a suo avviso agevolabile nella misura in cui risulti assimilabile a quelli per l’eliminazione delle barriere architettoniche. Ad ogni modo, ulteriori chiarimenti arriveranno con una circolare dell’Agenzia delle Entrate.
Ricordiamo che gli interventi finalizzati all’eliminazione delle barriere architettoniche sono incentivati con il Superbonus anche se nell’edificio non sono presenti disabili o anziani. La circolare dell’Agenzia chiarirà se e come i montascale rientrano tra gli strumenti che consentono il superamento delle barriere architettoniche.
Superbonus e sonde geotermiche
È stato inoltre chiesto se nei massimali di spesa previsti per i pannelli solari possano essere ricomprese anche le sonde geotermiche.
I Ministero ha risposto che, tra gli interventi trainanti “rientrano anche quelli di sostituzione degli impianti di climatizzazione invernale esistenti con impianti centralizzati dotati di pompe di calore e sistemi ibridi assemblati in fabbrica anche con sonde geotermiche ed eventualmente abbinati all’installazione di impianti fotovoltaici e relativi sistemi di accumulo”.
