I giudici si sono pronunciati sul ricorso contro l’ordinanza con la quale il Comune ha imposto la rimozione di un soppalco di ferro e pannelli di compensato di legno, realizzato all’interno di un garage.
Il soppalco misura quasi 27 metri quadri ed occupa quasi la totalità del garage. L’altezza rilevata tra il calpestio del soppalco e l’intradosso del solaio di copertura del garage è pari a circa 1,96 metri. Il soppalco è raggiungibile a mezzo di una scaletta in ferro con pedate in legno posta al lato in aderenza alla parete.
Secondo i responsabili, il soppalco non incide sul carico urbanistico e per la sua realizzazione non era richiesto il permesso di costruire, ma la Dia (oggi Scia).

I giudici hanno dato ragione al responsabile dell’intervento spiegando che la realizzazione di un soppalco costituisce un intervento la cui consistenza deve essere apprezzata caso per caso. Sarà riconducibile all’ambito della ristrutturazione edilizia, qualora sia idoneo a generare un maggiore carico urbanistico mentre, nel caso in cui i lavori siano tali da comportare una superficie accessoria, non utilizzabile per il soggiorno delle persone, potrà considerarsi un intervento minore.
Le caratteristiche del soppalco in questione hanno portato il Tar a concludere che il manufatto, realizzato all’interno di un garage, non presenta dimensioni significative, non è idoneo ad ospitare il soggiorno delle persone né ad alterare lo stato dei luoghi e non accresce il carico urbanistico dell’immobile.
I giudici hanno affermato che un manufatto con queste caratteristiche può essere realizzato con Dia/Scia e che la mancanza di tale segnalazione non è sanzionabile con la demolizione.
