Il Tar Calabria interviene sul concetto di costruzione e di edificio

Il proprietario di un immobile, a ottobre 2019 aveva chiesto il permesso di costruire per la realizzazione di una tettoia. Il Comune lo aveva negato perché non rispettava la distanza di 10 metri prevista dall’articolo 9 del DM 1444/1968. Il proprietario ha presentato ricorso sostenendo che la tettoia non aveva pareti laterali e non poteva quindi essere considerata come un edificio né creare intercapedini tra gli edifici, dannose per la salubrità e per l’igiene.
Tettoia, le distanze dagli edifici
I giudici hanno spiegato che tra i nuovi edifici, situati all’esterno dei centri storici, tra le pareti finestrate e le pareti di edifici antistanti deve esserci una distanza minima assoluta di 10 metri. Si tratta, come si legge nella sentenza, di una disposizione che “ha carattere inderogabile, poiché si tratta di norma imperativa, che stabilisce in via generale ed astratta le distanze tra le costruzioni, in considerazione delle esigenze collettive connesse ai bisogni di igiene e di sicurezza”. I giudici hanno aggiunto che, secondo la giurisprudenza amministrativa e civile, “ai fini dell’osservanza delle norme sulle distanze legali tra edifici di origine codicistica, la nozione di costruzione non può identificarsi con quella di edificio, ma deve estendersi a qualsiasi manufatto non completamente interrato che abbia i caratteri della solidità, stabilità, ed immobilizzazione al suolo, anche mediante appoggio, incorporazione o collegamento fisso ad un corpo di fabbrica preesistente o contestualmente realizzato, indipendentemente dal livello di posa e di elevazione dell’opera”. Secondo questa interpretazione, la tettoia, costituita da una struttura lignea, sorretta da 6 pilastri, avente copertura opaca di tegole a due falde, deve essere considerata come una nuova costruzione, rilevante ai fini del calcolo della distanza minima tra gli edifici. Il Tar, dopo aver rilevato che la distanza tra la tettoia e il nuovo edificio sarebbe risultata inferiore a 10 metri, ha quindi confermato il diniego del permesso di costruire.
